hi welcome james, rory is trying to setup a meeting with a berth sometime this week i think as of his phone call to there office on friday when rory was told that he berth was in dubai but he was due back on monday i will go to this meeting with him your welcome to come along a trash this out thats if you live in ireland? WE NEED ANSWERS TO OUR Q?.i for one are not happy about not been informed about what is going on? an may pull out of the deal.

Thanks Martin, I would definitly be interested in attending this meeting. I haven't dealt with Berth before, my contact was Karen in Profile's office in Spain, but i'm sure it's the same company and they have the same answers/policies. I'm living in Dublin, so if you could send me the details of when and where this meeting will be held, I'll pop along too.

Guys,

I can sympathasise with you sort of on what's happening with your 'delayed' projects in Sports City. I myself have purchased 2 apartments in Jumeirah Village South, and have already paid about 50% with nothing having even started yet.

What I wanted to know from you guys is that is there no clause in your contracts/sales agreement that says if the project is not handed over to you by xxxxxxx date, you have the right to ask for the money back with a penalty rate applied (i.e. interest) ?

Interested in your replies because I have a gut feeling that my projects too are going to be delayed big time, so I can see myslef being in your positions in the forseeable future

hi all got phone call from a guy in lornovo to day to say that there in the process of selling to an english developer? and there going to turn it in to an aparthotel an that we all will be getting a letter from them sometime this week? he didnt have much info only to say about the hotel bit,but i did say that if thats the case then we need a new contract, thoughts please.

The actual contract provides that the property shall be ready by the anticipated completion date however this may be extended by the developer to reflect any delay relating to building works for any circumstances beyond the developer’s control.
So if the developer does not complete on time, due to reasons within their control, it could be argued that they are in breach of contract and we are entitled to monies back.
However, the reason I received for the delay is that the developer was locked out of the site for so long (hmmmmmmm???????) and they will argue that this is out of their control.
Sounds like a made up excuse to me, considering all developments in Dubai seem to be delayed.

Now this is very interesting. Does this mean that no work has started yet at all??
Surely, due to the fact that the development is changing completely, and this is not what we agreed to buy, the english developer will have to reissue contracts, or offer a refund to those who do not want to be part of this development.
Is it just me, or is this all getting a bit much at this stage?????

Guys, I got onto both my solicitor and my contact in Profile yesterday. My solicitor got back to me saying that completion is now set at Dec 2008, and that this is when the final payment will be due. Although it's annoying that the completion date has been put back so long, at least the final payment is not due till the project is completed. Last I had heard was that the developer was looking for final payment early 2008, and completion late 2008, which I obviously objected to.
Profile haven't gotten back to me yet, but I'll keep you informed.

thanks james,i was told sometime in 2009 by the guy in lornovo got a letter today but not the one he told me i was to get,the one i got was to say that we are now the purchaser an not the leaseholder, now heres the nice bit:all fees and charges related to the reg and the change of status to freehold or associated expenses will be payed fo by the purchaser? ( james what solicitor are you useing can u pm me the number ples)

I think investing in cheaper properties near sports city would earn investors very handsome return in future.
