read your previous thread.ary has asked me to go to dubai and take pocession of ic1-o7 studio apt.they are asking 5800 dhm fro maitainance charges by Nakheel.u were discussing a decrease in that amount.Has there been any progress on that front??

I received a reply from Sara of Nakheel regarding ARY charges as below. Seems like we do have a leg to stand on afterall......by the way,I have simply copied her reply from the mail, nothing has been changed.

It may be wise if individuals get something in writing for themselves from Sara.

"Thank you for your patience.

Regarding the charges required by the building owner, please note the
followings:
* Late payment surcharge is not required by Nakheel.
* Service charge is the amount payable for one annum in advance
from the handover date for the maintenance of the building.
* Land registration fee: 1.5% if your contract with Nakheel is
issued before 17/12/2006 or 1% if your contract is issued on of after
17/12/2006
* Survey and inspection charges: please check your contract with
the building owner.
* Clearance and handling over charges: please check your contract
with the building owner
* ARY service charges: not applicable as Nakheel is undertaking
the service and maintenance of the building.
* Sub division of the unit: is the responsibility of the building
owner to register the sold units in the building with the lands
department and no building owner has the legal right to pass this charge
to the unit owners.
* Deposit to DEWA meter: AED1,000

Hi Aliya ! I tried to fone sara mohammed up this morning but she was out of the office but I am gonna email her about the late payment surcharge from ARY. I dont know what should I do ? When is it all gonna resolve? Do you think Aliya that ARY will take their stupid charges away? Could you please share with us the charges ARY wants you to pay and I will attach mine as well. I cant even remember wht the run down of the charges is because I booked it from Karachi on my younger brother's name and ARY gave him a never ending list of charges I am gonna ask him to attach me the whole list n we will take it from there...Hope all goes well..

Hi all,

Sorry to hear all your hassle and distress youve had through using this company, these things that they do and the way they mess you around and mis-lead you aswell as the constant lies really makes my blood boil...!!!!

Guys where yor solicittors and what do they have to say about it??

Also payments should be linked to build stages throughout construction periods and this should be in your contracts also?

You should not be handing over money without being instructed to do so by tyour solicitor until they receive an official builidng and engineer certification stamped and signed by developers declaring completion of a certain stage i.e foundations, roof level, completion etc!

COMPLETION IS COMPLETION!! You should not be handing over your final completion payment until you have visited your apartment and completed a snagging list and you are happy with the standard,build, finish and the specification that you have been promised!

What are your clauses in the contracts as they normally have a set for the "BUYERS" and one set for the "DEVELOPERS"?? So see what the penalty clauses are for if they dont deliver your property on the original specified completion date??

I really wouldnt pay any more money over guys until you have confirmation of what is going on also wheres your solicitor thats what theyre there for-your paying them to act in your best interests arent you...????

Hello Aliya ary put above 5000 AED in terms of late payment markup and as per NAB agrement is there any way to bypas this amount or just pay and get possesion policy? becoz dubai and khi both offices says peoples r abusing and paying this amount sometimes they says its from nakheel blah per NAB agrement blah blah what u suggest in this situation?

I would suggest that the individuals should write an email to Sara at Nakheel asking her to confirm which of the items in your last invoice from ARY are to be paid as you are disputing them. She will need to see a copy of this last invoice which you should send either by email or fax....I sent it by fax. She does respond but have found it to be slow, but I appreciate that she must have lots of queries....but you need to be patient. On the subject title of your message make sure you clearly state your apartment details. If you do not get a reponse after ..........one day.................not seriously, after say, a week, send a reminder and then follow up by a call to her direct number but re dial later if it goes to her voice mail....do not go via switch board as they do not put you through....well they did not put me through....after putting me on hold for a while and obviously speaking to someone....cheeky monkeys!! I re dialled her direct number after a day and that was when I was told by her that there is a meeting being held between nakheel and ARYand she would respond after that. I did chase her for a response and made calls to her saying that did say that she would respond and that was when she did say that ARY would send her a new breakdown and she was waiting for it but I could request it directly from ARY. I did send a request to ARY but as usual I did not get anything from them. So I sent Sara a message that I needed the breakdown as ARY were not responding......hey presto...she sent it to me which is what I have posted on this site. I would still like to see what ARY will send me. If they do not take off the charges and other items,then I will inform them of my mail from Sara. Let's see what happens. Be sure to keep copies of your mails from Sara, I think Nakheel need to be informed of ARY's dealings as I do not think that they are fully aware of it, so up to us to bring it to their attention. The more people complain the better........post your responses here!!!

Default Good News for ARY Building U#18 Unit Owners

I just now called the ARY Islamabad office and was told that U#18 has already been handed over to ARY; they have already received the mail.

Tomorrow, they will receive the letters from Dubai office and then after 02 days letters would be delivered to the unit owners in Pakistan.

Mr.Pervez, Islamabad Office, (0300-9558469) could be contacted for the latest.

I think now we should buckle up and get ARY correct their nonsense so called extra charges.

Hi ALL!! yes u r rite Aliya collective complaints will have better impact for our perspective. I emailed her the other day but I am being stupid, forgot to send her the details of my apartment. But I really appreciate her instant reply. She emailed me next day asking for my flat details. I have emailed her all the details straight away and as soon as I get any response from her I will let u guys know. ARY cheaters wasting our time u know. By this time we cud have got the possession n cud have rented out our flats as well. Please do write if anything useful crops up..thnxx alot

Reading the agony and desperation of the people i hope the UAE government is learning something out of this. I suggest if the newspapers can get behind you guys ARY would get the treatment it deserves.
I think it is time Nakheel got up from their big bottoms and did something useful to the suffering investors. I think this plight has to be brought to the attention of world media and I don't even think people can put this saga to teething problems with Dubai's property market. These people can be professional when it comes to impressing the west and trample over the weak.
I suggest someone post the web link to Sara Mohammed and all the local newspapers in the UAE. If they can only get professional with high end property market then I think this whole property issue is a sham!!

shame on NAKHEEL(AND UAE GOVERNMENT) THAT can't protect its investors from a bandit like ARY!!
