Unfortunately we and dozens of others have fallen foul of a dishonest and unscrupulous developer, as a result of which our hopes and dreams of a new life in Spain are ruined.

The problem is that the Developer has organized his company Accounts so as to make it ?appear? he has severe cash flow problems. This way anyone carrying out a search of the company is put off commencing legal proceedings for fear of failing to recover either their debts or any legal costs which may be incurred. Solicitors seem impotent just saying ?we don?t think he has any money?, why can?t they find out? It?s a little difficult to understand how they can protect their Clients interests and not have access to this vital information.

In the meantime the Developer lives like a king in a one million plus euro finca, runs several high powered and expensive cars, has a collection of thoroughbred dressage and show horses and boasts of having land in his own name valued at over 3 million euros. Talk about rubbing your nose in it!!

The question:

How do we search and establish his real assets and make him accountable for his debts, it seems strange that in a country with tough bankruptcy laws that it is relatively simple to hide large assets in order to avoid accountability for debt.

Is this legal, can anyone out there help?

I do hope that you enjoy your time with us and I am sorry to hear about your problem you are having with the developer, I don?t know if this will help you but have you tried the Ombudsman?
